This page provides information about which personal data are processed through the use of this website and its offers by BERGER Group, August BERGER Metallwarenfabrik GmbH, Bruchbergstraße 66, 76768 Berg (“BERGER”) and for which purposes this data is used.

1. Whose personal data are processed (category of data subjects)?
Persons affected by processing are all visitors and users of the BERGER website (collectively referred to as “users”).
2. What data is processed when visiting the BERGER website?
When visiting BERGER’s website, BERGER’s servers automatically store various data about the accessing system (“access data“).

- Host name of the accessing computer
- Time of the server query
BERGER uses this access data in order to make the website accessible, to recognize and remedy any technical problems that may arise and to prevent and, if necessary, prosecute misuse of BERGER’s offer.

3. What are cookies and how are they used?
BERGER uses cookies to improve presentation and navigation. A cookie is a text file sent from the web server to the browser. This file contains the URL visited, the date of the visit and an expiration date that determines the period of activity of the cookie. On the one hand, BERGER uses cookies to determine popular areas of BERGER websites and, on the other hand, to enable the user to save their personal settings so that they are available again the next time the page is visited. To identify popular, visited areas of the BERGER website aggregated statistics are created from website visits.

4. Integration of third party services
Within this website, BERGER employs content or service offerings of third party suppliers on the basis of the legitimate interests of BERGER (i.e. interest of BERGER regarding analysis, optimization and economic operation of the online offer within the meaning of Art. 6 para. 1 letter f) of the GDPR), such as may include videos or fonts.
Google Web Fonts
This site uses so-called web fonts, provided by Google, for the uniform representation of fonts. When you call up a page, your browser loads the required web fonts into your browser cache to display texts and fonts correctly.
To do this, your browser must connect to Google’s servers. As a result, Google learns that our website has been accessed via your IP address. The use of Google Web Fonts is in the interest of a consistent and attractive presentation of our online services.

Google Analytics
This website uses functions from the Google Analytics web analytics service. The provider is Google Inc., 1600 Amphitheater Parkway, Mountain View, CA 94043, USA.

IP anonymization
BERGER has activated the IP anonymization function on this website. As a result, your IP address will be shortened by Google within member states of the European Union or other states party to the Agreement on the European Economic Area prior to transmission to the United States. Only in exceptional cases will the full IP address be sent to a Google server in the US and shortened there. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on website activity and to provide other services related to website activity and internet usage on behalf of the website operator. The IP address provided by your browser to Google Analytics as part of the Google Analytics process will not be merged with other Google data.

BERGER has entered into a contract processing agreement with Google and fully implements the strict requirements of the German data protection authorities when using Google Analytics.
Demographics features in Google Analytics
This website uses the demographics features of Google Analytics. As a result, reports may be produced that contain statements about the age, gender and interests of site visitors. This data originate from interest-based advertising from Google as well as third-party visitor data. This data cannot be associated with a specific person. You can disable this feature at any time through the ad settings in your Google Account, or generally prohibit the collection of your data by Google Analytics as outlined in the section “Prevent data collection”.
5. Plug-ins and tools
Youtube with extended data protection
BERGER uses plug-ins from the YouTube website. The site operator is YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066, USA.
We use YouTube in enhanced privacy mode. This mode, according to YouTube, means that YouTube does not store information about visitors to this site before they watch the video. However, sharing data with YouTube partners is not necessarily excluded in enhanced privacy mode. So, regardless of whether you watch a video, YouTube still connects to the Google DoubleClick network.
Once you start a YouTube video on our website, it will connect to YouTube’s servers. It informs the YouTube server about which of our pages you’ve visited. If you’re logged into your YouTube account, YouTube will allow you to associate your browsing behaviour directly with your personal profile. You can prevent this by logging out of your YouTube account.
In addition, after starting a video, YouTube may store various cookies on your device. With the help of these cookies, YouTube is able to collect information about visitors to our website. This information will, amongst other things, be used to capture video statistics, improve usability and prevent fraud. The cookies remain on your device until you delete them.
If necessary, after the launch of a YouTube video, additional data processing operations may be triggered over which we have no control.

BERGER integrates the maps of the Google Maps service provided by Google LLC, 1600 Amphitheater Parkway, Mountain View, CA 94043, USA. Inclusion of Google Maps is in the interest of an attractive presentation of the online offer and to ensure easy location of the places specified by BERGER on the website. This constitutes a legitimate interest within the meaning of Art. 6 para. 1 lit. f GDPR.

6. Online presence on social media
BERGER maintains an online presence within social networks and platforms in order to communicate with active customers, prospective customers and users and to inform them about its services. When visiting the respective networks and platforms, the terms and conditions and the data processing guidelines of their respective operators apply.
Unless otherwise specified in this privacy policy, BERGER will process users’ data as long as they communicate with BERGER within social networks and platforms, e.g. write articles on BERGER’s online presence or send BERGER messages.
7. Communication using the email functions / contact form
BERGER offers the option to contact BERGER by email and to write messages that, at the discretion of the user, go beyond disclosure of the sender’s email address and may also disclose other personal data (e.g. first name and surname, title, address, telephone number, e-mail text, context of the request). The user decides about the nature and extent of the information disclosed beyond the email address.
The data will not be used for other purposes or passed on to third parties without your express consent. This excludes our subsidiaries, for the purposes of fulfilling your request. If there are no statutory storage requirements, your personal data will be deleted after the request has been processed.
The legal basis for data processing is Article 6 para. 1 letter f) GDPR. Our legitimate interest is that BERGER needs your information in order to process or respond to your message.
8. Transmission and transfer of personal data to third parties
BERGER transmits personal data to its subsidiaries for the above mentioned purposes. Transmission takes place, in particular, when the user’s email requests (see Section 6 above) come under the business areas / offers of the respective subsidiaries.
The legal basis for the above mentioned transfer of personal data is Article 6 para. 1 letter f) GDPR.
BERGER works with technical service providers (so-called processors) as part of the provision of the website, such as IT application and web management service providers who access personal data to provide these services. These service providers are carefully selected, operate only as directed by BERGER and are contractually bound to comply with applicable data protection requirements and are not resident in third party countries. The legal basis for the above-mentioned transfer of personal data is Article 6 para. 1 letter f) GDPR.
Furthermore, reference is made to the transmission of information in the course of the use of cookies described in detail in Sections 3-5.
Except as set forth in this Privacy Policy, BERGER will only disclose data to third parties without your explicit consent, if BERGER is required to do so by law or by any official or court order.
9. Deletion periods
Access data (see Section 2) are deleted if their knowledge is no longer required for the purposes described in this privacy policy, unless statutory provisions prescribe a longer storage period. Access data is regularly stored for a period of 30 days.
The personal data collected using BERGER’s email function / contact form (see Section 7) will be deleted as soon as they are no longer required for data processing, i.e. regularly, once the request has been finalized.
10. Rights of the user
The user has the following rights or entitlements. Their assertion is processed immediately and does not lead to any disadvantages for the user.

The user also has the right to lodge a complaint with a data protection authority if they consider that the processing of their personal data by BERGER violates the GDPR. In addition to the data protection authority responsible for BERGER (see Section 11 below), the acting watchdog authorities at the habitual residence of the user, the user’s workplace and the location of the alleged infringement are also responsible. Additional rules on the appeal procedure can be found under Art. 77 GDPR.

12. SSL or TLS encryption
This website uses an SSL / TLS encryption for security reasons and to protect the transmission of confidential content, such as the enquiries that you send to us BERGER the website operator. You can identify an encrypted connection by the fact that the address line of the browser changes from “http://” to “https://” and by the lock symbol that appears in your browser line.
If the SSL / TLS encryption is activated the data that you transmit to BERGER cannot be read by third parties.
